Terms of Service

Last Updated: October 30, 2026

1. Introduction and Acceptance

Welcome to AthleticOS.

These Terms of Service ("Terms") govern access to and use of the AthleticOS technology platform and its associated products, websites, applications, administrative systems, and services (collectively, the "Services").

The Services are provided by AthleticOS LLC ("AthleticOS," "we," "our," or "us").

AthleticOS develops and operates technology designed to support athletic departments, educational institutions, athletic organizations, coaches, student-athletes, families, and athletics media.

The Services may include AthleticOS websites and content management systems, RecruitOS, StatOS, ScoreOS, StoryOS, PreviewOS, RecapOS, PushOS, GameDayOS, AppOS, AdminOS, authorized communications features, mobile applications, artificial intelligence-assisted tools, and other related products or services.

By creating an account, accessing an authenticated feature, accepting an order, or otherwise using the Services, you agree to these Terms to the extent applicable to your use.

If you use the Services on behalf of a school, district, organization, or other entity, you represent that you have authority to bind that entity to these Terms. If you lack that authority, you may not accept these Terms on its behalf.

Additional written agreements, order forms, or product-specific terms may apply to particular Services. In the event of a conflict, an applicable signed agreement or mutually accepted order form controls to the extent of that conflict.

2. The AthleticOS Platform

AthleticOS provides software, digital publishing tools, athletics information management systems, recruiting technology, communications features, and related services.

Depending on the products purchased or activated, functionality may include:

  • Athletics websites and custom domain support.
  • Sport schedules, rosters, coaches, scores, and statistics.
  • News publishing, game previews, recaps, and other editorial content.
  • Athlete recruiting profiles and recruiting-related materials.
  • School-branded mobile applications and notifications.
  • Audio, video, photography, podcasts, and other media integrations.
  • Sponsor and advertising content management.
  • Administrative accounts, permissions, and workflows.
  • Artificial intelligence-assisted content and data preparation.
  • Authorized school, team, and organizational communications.

Available features may vary by customer, subscription, user role, product configuration, and technical availability.

AthleticOS may improve, modify, replace, or discontinue features as the platform evolves, subject to applicable customer agreements and law. We will provide appropriate notice of material changes when required or reasonably practicable.

3. Accounts, Authorized Users, and Security

Certain Services require registration or access through an authorized account.

Users agree to provide accurate account information, maintain the confidentiality of their credentials, and promptly report suspected unauthorized access.

Accounts must be used only by the individuals or organizations authorized to access them. Users may not share credentials in a manner that circumvents permissions, licensing restrictions, or security controls.

Schools and organizations are responsible for managing their authorized representatives, assigning appropriate roles, and requesting the removal of access when personnel leave or change responsibilities.

AthleticOS may suspend or restrict access when reasonably necessary to address security threats, unauthorized activity, violations of these Terms, or risks to other customers.

Nothing in these Terms authorizes a user to access another school's information, administrative systems, or private records.

4. Ownership of AthleticOS Technology

AthleticOS and its licensors retain all rights, title, and interest in the Services and their underlying technology.

This includes, to the extent owned by AthleticOS or its licensors:

  • Software and source code.
  • Application architecture and proprietary implementations.
  • Database structures and platform configurations.
  • Administrative systems and workflows.
  • Original website themes and interface components.
  • Proprietary graphics, templates, and design systems.
  • Platform documentation.
  • AthleticOS, RecruitOS, and related trademarks and branding.
  • Improvements, enhancements, and derivative works of AthleticOS technology.

Except for rights expressly granted in writing, access to the Services does not transfer ownership of AthleticOS intellectual property.

Customers receive a limited, non-exclusive, non-transferable right to access and use the subscribed Services for their authorized purposes during the applicable service period.

No right to receive source code, proprietary documentation, internal system architecture, or unrestricted software copies is granted unless expressly agreed in writing.

The Services may incorporate third-party or open-source components governed by their respective licenses. Nothing in these Terms limits rights granted directly by those licenses.

5. Restrictions on Platform Use

Users and organizations may not, except where expressly authorized by AthleticOS or permitted by applicable law:

  • Copy, reproduce, redistribute, sell, sublicense, or commercially exploit AthleticOS proprietary software.
  • Reverse engineer, decompile, or attempt to obtain nonpublic source code or proprietary implementations.
  • Circumvent authentication, licensing, security, or access controls.
  • Access or attempt to access another customer's private data or restricted administrative areas.
  • Use automated tools to extract protected platform information without authorization.
  • Interfere with service security, functionality, or availability.
  • Introduce malware, malicious scripts, or harmful code.
  • Misrepresent affiliation with AthleticOS or another organization.
  • Remove proprietary notices or falsely claim ownership of AthleticOS technology.
  • Use the Services to violate applicable laws or third-party rights.

These restrictions do not prohibit lawful use of information that is publicly available, permitted interoperability, or activities that cannot legally be restricted by contract.

6. Customer Content and Ownership

Schools, athletic departments, organizations, and authorized contributors retain their ownership rights in the content they lawfully provide to AthleticOS ("Customer Content").

Customer Content may include:

  • School names, logos, and branding.
  • Athlete and coach information.
  • Rosters, schedules, scores, and statistics.
  • News articles and editorial materials.
  • Photographs, videos, and audio.
  • Sponsor names and graphics.
  • Recruiting information and athlete profiles.
  • Documents and uploaded files.
  • Other materials submitted through the Services.

AthleticOS does not claim ownership of Customer Content merely because it is uploaded, stored, displayed, or processed through the platform.

By submitting Customer Content, the submitting customer or user grants AthleticOS a non-exclusive, worldwide, royalty-free license, for the period reasonably necessary to provide the Services and perform authorized post-termination activities, to host, store, reproduce, process, format, transmit, display, publish, and distribute that content as necessary to operate the Services, carry out authorized customer instructions, and provide associated technical functions.

This license is limited to the purposes described in these Terms, applicable customer agreements, and our Privacy Policy.

AthleticOS will not acquire ownership of a school's original branding, articles, photographs, or other Customer Content through this license.

Content supplied by third parties remains subject to their underlying ownership and licensing rights.

7. Customer Content Rights and Permissions

Customers and contributors are responsible for ensuring that they have the necessary rights, permissions, consents, or lawful basis to submit and authorize the intended use of their content.

This may include permissions involving:

  • School and institutional trademarks.
  • Sponsor and business logos.
  • Copyrighted photographs and videos.
  • Music, broadcasts, and recorded performances.
  • Athlete and coach photographs.
  • Student information and recruiting materials.
  • Articles, graphics, and other creative works.
  • Personal information about students or other individuals.

Customers represent that they have the legal authority necessary to provide the content they submit and grant the applicable license described in these Terms.

Customers must not intentionally upload stolen, unlawfully obtained, infringing, or unauthorized proprietary material.

AthleticOS may investigate complaints, request documentation of content rights, restrict disputed materials, or remove content when reasonably necessary to comply with law, protect affected parties, or enforce these Terms.

AthleticOS also retains its own independent obligations under applicable privacy, copyright, consumer-protection, and other laws. These Terms do not shift those legal obligations entirely to schools or contributors.

8. Student-Athletes, Minors, and Educational Information

AthleticOS serves athletic programs that may involve minors and educational institutions.

Students' names, photographs, school affiliations, athletic statistics, biographies, recruiting information, and other materials must be handled consistently with applicable privacy laws and institutional policies.

Schools and organizations are responsible for determining which users are authorized to submit or publish information through their accounts and for providing AthleticOS with appropriate instructions concerning access and publication.

AthleticOS will process student information as described in its Privacy Policy, applicable written agreements, and any applicable student-data or data-processing agreements.

Where applicable, the parties will comply with their respective obligations under the Family Educational Rights and Privacy Act (FERPA), the Children's Online Privacy Protection Act (COPPA), and relevant state student-privacy laws.

Nothing in these Terms constitutes blanket parental consent, overrides student privacy rights, or authorizes unrestricted public disclosure of educational records.

AthleticOS may establish additional age requirements, parental or guardian verification procedures, and product-specific safeguards for features involving minors.

9. RecruitOS and Recruiting Information

RecruitOS provides tools for presenting athletic information, recruiting profiles, achievements, statistics, media, and related materials.

RecruitOS is a technology and information service. Unless expressly stated in a separate written agreement, AthleticOS does not act as an athlete's recruiting agent, college representative, or scholarship placement service.

AthleticOS does not guarantee:

  • Recruitment by a college or university.
  • Contact from college coaches.
  • Scholarship offers.
  • Athletic eligibility or admission.
  • Selection to a team or program.
  • The accuracy of externally submitted recruiting information.

Athletes, guardians, coaches, and authorized administrators are responsible for reviewing the information they submit or approve for publication.

Users must not fabricate athletic achievements, misrepresent offers, impersonate another athlete or institution, or knowingly publish false recruiting credentials.

AthleticOS may correct, restrict, or remove information that violates these Terms or applicable law.

10. Statistics, Scores, and Athletic Information

AthleticOS provides tools to collect, manage, calculate, publish, and display athletic information.

Information may be entered manually, imported from authorized sources, submitted by customers, calculated from existing records, or processed through automated systems.

Although AthleticOS works to maintain reliable platform functionality, we do not independently guarantee that every score, statistic, roster entry, game status, schedule, or historical record is accurate.

Schools and authorized contributors are responsible for reviewing material information before publication and correcting known errors.

Publicly displayed data may change following corrections or updates.

AthleticOS is not responsible for athletic association rulings, eligibility determinations, championship classifications, recruiting decisions, or other decisions made by independent organizations.

11. Artificial Intelligence and Automated Features

Certain AthleticOS Services may use artificial intelligence or other automated technologies to assist with writing, editing, data extraction, importing, organizing, summarizing, graphics preparation, or administrative workflows.

AI-generated output may contain inaccuracies, omissions, inconsistencies, or incomplete information.

Users are responsible for reviewing AI-assisted output before relying upon it for consequential decisions or publication, including athlete statistics, game results, recruiting information, and public communications.

AthleticOS does not warrant that AI-generated material is error-free, unique, suitable for every purpose, or free from third-party rights concerns.

Customers must have appropriate rights or authorization to submit materials for processing.

Use of submitted information, third-party AI providers, and applicable data protections will be governed by the Privacy Policy, relevant service agreements, and any additional disclosures or consents required by law.

AI-assisted features do not relieve AthleticOS of obligations imposed by applicable law.

12. Mobile Applications and Notifications

AthleticOS may provide native mobile applications customized for participating schools and organizations.

Application availability and functionality may depend on operating systems, app stores, device capabilities, network conditions, and third-party infrastructure.

Push notifications and other alerts may contain scores, news, school announcements, athletic information, and other authorized communications.

Delivery is not guaranteed, and notifications may be delayed, filtered, disabled, or unavailable.

Users may manage available notification permissions through their devices and application settings.

Mobile applications are also subject to applicable Apple App Store or Google Play policies and terms.

13. Communications and Messaging

Where communications or messaging features are offered, users must communicate lawfully, respectfully, and within their authorized roles.

Users may not use those features to harass, threaten, exploit, impersonate, or unlawfully contact another person.

Special access restrictions, reporting procedures, and safety requirements may apply to interactions involving minors.

AthleticOS may restrict communication features or investigate reports of misuse in accordance with applicable policies, agreements, and law.

Additional product-specific terms, privacy disclosures, parental or guardian controls, and consent requirements may apply before particular communications features become available.

14. Third-Party Services and Integrations

The Services may interact with third-party products, websites, APIs, hosting providers, media platforms, payment processors, and other technology services.

Examples may include video platforms, social media services, athletics data providers, cloud infrastructure, and external content sources.

Third-party services operate under their own applicable terms and privacy practices.

AthleticOS does not control the availability, reliability, security, or policies of independent third-party services.

Links, embeds, and integrations do not necessarily imply sponsorship, endorsement, ownership, or affiliation.

Customers remain responsible for obtaining required permissions or licenses for third-party materials they submit or connect to the Services.

Nothing in these Terms grants users rights to third-party intellectual property beyond those provided by the applicable rights holder.

15. Subscriptions, Fees, and Payment

Certain Services require a paid subscription or other commercial arrangement.

Pricing, payment schedules, subscription durations, included products, renewal conditions, cancellation rights, and any applicable implementation fees will be governed by the customer's accepted order form, invoice terms, or separate service agreement.

Unless a written agreement states otherwise, access to paid Services is conditioned on timely payment of applicable charges.

AthleticOS may suspend paid Services for material nonpayment following any notice or cure period required by the applicable agreement or law.

Fees, renewals, and cancellations will be administered in accordance with applicable law and the governing customer agreement.

These public Terms do not independently create an automatic-renewal commitment or override negotiated pricing protections.

16. Customer Websites and Custom Domains

Customers may connect approved domain names to AthleticOS-hosted websites or recruiting experiences.

Customers are responsible for maintaining ownership or authorized control of domains they supply, including domain registration and applicable third-party registrar charges unless otherwise agreed.

AthleticOS may assist with DNS configuration, domain routing, SSL provisioning, and related technical services.

Availability of a particular domain or uninterrupted operation of third-party DNS services is not guaranteed.

Upon termination, customers remain responsible for transferring, renewing, or maintaining any customer-controlled domain registrations.

Any domain purchased or registered by AthleticOS on behalf of a customer will be governed by the applicable written agreement and registration arrangements.

17. Service Availability, Maintenance, and Security

AthleticOS uses commercially reasonable efforts to operate and maintain its Services.

The platform may experience maintenance periods, interruptions, software defects, provider outages, cybersecurity incidents, or circumstances outside our reasonable control.

AthleticOS does not promise uninterrupted availability unless a specific service-level commitment is provided in writing.

We may perform maintenance, deploy updates, change infrastructure, or temporarily restrict access when reasonably necessary to protect the platform and its users.

We maintain security practices appropriate to the Services, subject to applicable contractual and legal requirements.

No internet-connected service can guarantee absolute security.

Users should promptly notify AthleticOS of suspected unauthorized account activity, vulnerabilities, or misuse.

18. Intellectual Property Complaints

AthleticOS respects the intellectual property rights of others and expects customers and users to do the same.

Rights holders who believe material available through the Services infringes their rights may contact AthleticOS at support@athleticos.com with sufficient information to identify the work, the allegedly infringing material, the location of the content, and the basis for the complaint.

AthleticOS may review complaints, remove or disable access to disputed content, and take appropriate action consistent with applicable law.

Where applicable, AthleticOS will maintain procedures for notices and counter-notices under the Digital Millennium Copyright Act (DMCA).

AthleticOS may terminate accounts of repeat infringers in appropriate circumstances.

19. Feedback and Product Suggestions

Customers and users may voluntarily provide feedback, ideas, suggestions, or feature requests concerning the Services.

Unless otherwise agreed in writing, AthleticOS may use such feedback to develop, improve, and operate its products without owing compensation.

This does not transfer ownership of Customer Content, authorize use of confidential customer information outside applicable agreements, or override third-party intellectual property rights.

20. Suspension and Termination

AthleticOS may suspend or terminate access when permitted under an applicable agreement or law, including for:

  • Material violations of these Terms.
  • Fraudulent or unlawful activity.
  • Unauthorized access or security threats.
  • Material nonpayment.
  • Serious misuse of the Services.
  • Legal or regulatory requirements.

Where reasonably appropriate, AthleticOS may provide notice and an opportunity to resolve the issue.

Customers may terminate Services according to their applicable subscription or service agreement.

Following termination, access to some or all paid functionality may end.

Customer Content may be retained, exported, returned, or deleted according to applicable agreements, our Privacy Policy, retention requirements, and law.

AthleticOS will not claim ownership of Customer Content simply because a subscription ends.

Provisions that by their nature should continue after termination, including ownership, payment obligations, liability limitations, and dispute-resolution provisions, will survive to the extent legally enforceable.

21. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR EXPRESS WARRANTIES PROVIDED IN A SEPARATE WRITTEN AGREEMENT, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

ATHLETICOS DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH DISCLAIMERS ARE LEGALLY PERMITTED.

ATHLETICOS DOES NOT GUARANTEE PARTICULAR ATHLETIC, RECRUITING, FINANCIAL, MARKETING, OR ADMINISTRATIVE OUTCOMES FROM USE OF THE SERVICES.

NOTHING IN THIS SECTION EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER ATHLETICOS NOR ITS APPLICABLE OFFICERS, EMPLOYEES, OR SERVICE PROVIDERS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST OPPORTUNITIES, OR BUSINESS INTERRUPTION, ARISING FROM USE OF THE SERVICES.

EXCEPT FOR LIABILITIES THAT CANNOT LAWFULLY BE LIMITED OR ARE EXPRESSLY EXCLUDED FROM THIS LIMITATION BY A SEPARATE AGREEMENT, ATHLETICOS'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT PAID OR PAYABLE BY THE APPLICABLE CUSTOMER TO ATHLETICOS FOR THE AFFECTED SERVICES DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

23. Indemnification

To the extent permitted by applicable law, business customers and organizations agree to defend, indemnify, and hold harmless AthleticOS from third-party claims arising from:

  • Customer Content that infringes another party's rights.
  • The customer's material breach of these Terms.
  • The customer's unauthorized or unlawful use of the Services.
  • The customer's failure to obtain required permissions for content it directs AthleticOS to publish or process.

This obligation applies only to the extent the claim results from the customer's acts, omissions, or responsibilities and does not require indemnification for AthleticOS's own negligence, misconduct, breach, or independent legal violations.

Any indemnification obligation applicable to public schools, government entities, or other organizations with statutory restrictions will be limited to the extent allowed by applicable law and any governing written agreement.

24. Privacy and Data Protection

AthleticOS handles personal information as described in its Privacy Policy and applicable data-protection agreements.

The Privacy Policy explains applicable categories of information collected, purposes of processing, service-provider disclosures, retention practices, user rights, and relevant contact information.

Where a written student-data agreement or data-processing agreement applies, that agreement will supplement these Terms and control in the event of a conflict concerning covered data.

Privacy-related requests may be directed to support@athleticos.com, subject to the request procedures stated in the Privacy Policy.

25. Changes to These Terms

AthleticOS may revise these Terms to reflect changes in law, platform operations, security requirements, or available Services.

Updated Terms will be published with a revised effective date.

Where required by law or where changes materially affect existing customer rights, AthleticOS will provide appropriate notice and obtain any required consent.

Changes will not retroactively override an existing signed customer agreement unless permitted by that agreement and applicable law.

Continued use following the effective date of a validly communicated update may constitute acceptance to the extent permitted by law.

26. Governing Law and Disputes

Unless otherwise provided in an applicable written agreement or required by law, these Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Any court proceeding arising under these Terms will be brought in a court with appropriate jurisdiction in Alabama, except where applicable law or a binding customer agreement requires otherwise.

Nothing in this section eliminates legal rights or remedies that cannot be waived.

27. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain effective to the extent permitted by law.

Failure to enforce a provision does not constitute a permanent waiver of that provision.

These Terms, together with applicable order forms, referenced policies, and written agreements, constitute the applicable agreement concerning use of the Services.

Users may not assign their rights under these Terms without authorization where such consent is lawfully required. AthleticOS may assign its rights and obligations in connection with a legitimate corporate transaction, subject to applicable law and contractual restrictions.

No agency, partnership, employment, or joint venture relationship is created solely through use of the Services.
